Terms of Use
1. Agreement to These Terms
These Terms of Use (the “Terms”) govern your use of jurelleenterprises.com and everything on it (the “Site”). By using the Site, you agree to these Terms. My Privacy Policy explains how I handle personal information. If you do not agree to these Terms, please do not use the Site.
Paid work is governed by a separate written agreement (see section 11). If that agreement conflicts with these Terms, the agreement controls for that work.
2. Who I Am
The Site is owned and operated by Jurelle Enterprises LLC, a New Jersey limited liability company. Tyler Jurelle, its founder and sole member, runs the Site. Tyler Jurelle is also a registered trade name of Jurelle Enterprises LLC, used for its creative and content brand at tylerjurelle.com.
In these Terms, “I,” “me,” and “my” mean Jurelle Enterprises LLC. Where a section concerns a person’s name, image, likeness, or voice, they mean Tyler Jurelle personally. Every protection these Terms give Jurelle Enterprises LLC also extends to Tyler Jurelle personally and to the company’s contractors and agents. “You” means anyone who visits or uses the Site, and any business or organization you use it for.
3. Who May Use the Site
- The Site is intended for businesses and adults. You must be at least 18 years old to submit a form.
- You must follow every law that applies to your use of the Site.
- If you use the Site for a business or other organization, you confirm that you can accept these Terms on its behalf.
4. How You May Use the Site
I give you a personal, non-exclusive, non-transferable, revocable license to view the Site for your own use, including to evaluate the company’s services for your business. Under that license, you may:
- read and view pages, and share links to them;
- quote short excerpts for commentary, criticism, news reporting, teaching, or research, with credit to Jurelle Enterprises and a link to the page;
- print or save a page for your own reference.
Any other use needs my written permission.
5. What You May Not Do
You may not, and may not help anyone else to:
- copy, republish, sell, license, or commercially use any Content (defined in section 6), including service descriptions, processes, and page copy, without my written permission;
- frame or mirror the Site, or embed its images on another site by linking to my files;
- use bots, scrapers, or other automated tools except as section 8 allows;
- use Tyler Jurelle’s name, image, likeness, or voice in any way section 7 prohibits;
- impersonate me or anyone else, or suggest a connection with me, or an endorsement by me, that does not exist;
- access, probe, test, or disrupt the Site, its servers, or its security, or overload it with requests;
- send malware, spam, or anything unlawful, defamatory, obscene, hateful, or harassing, or anything that infringes another person’s rights;
- harass, threaten, or stalk me or anyone else, or try to find, publish, or use private information about me or anyone connected to the company;
- send false, automated, or misleading form submissions;
- use the Site in any way that breaks the law or these Terms.
6. Ownership of Content
All content on the Site, including writing, service descriptions, photographs, graphics, logos, page design, and code (the “Content”), is owned by me or used under license from photographers, stock image libraries, and other owners. It is protected by United States and international copyright, trademark, and other laws. All rights not expressly granted in these Terms are reserved, and using the Site gives you no ownership of or license to Content beyond section 4.
Who owns the work I deliver to clients is set out in each written agreement, not in these Terms.
7. Name, Image, Likeness, and Voice
Tyler Jurelle’s name, image, likeness, voice, signature, and biographical details (together, “Likeness”) are protected by rights of publicity and privacy, in addition to copyright and trademark law. Without prior written permission from Tyler Jurelle or Jurelle Enterprises LLC, you may not use Likeness:
- in advertising, marketing, or any other commercial setting, or in any way that suggests I endorse or am connected to a product, service, cause, or person;
- to create, train, prompt, or edit artificial intelligence, deepfake, voice-cloning, or other synthetic or altered media;
- to create or run a profile or account, or to pose as Tyler Jurelle or the company;
- in edited, manipulated, or misleading versions of photos or videos, or in defamatory or demeaning content.
The Terms of Use on tylerjurelle.com set out these rights in full.
8. Search Engines, AI, and Automated Access
Search engines and AI search or answer services may crawl the Site, as my robots.txt file allows, to index pages and to show links, short excerpts, and summaries that credit and link back to the page they came from.
Unless I give you a written license, you may not:
- use Content or Likeness to train, fine-tune, test, or improve any artificial intelligence or machine learning model, or include them in a dataset used for that purpose;
- scrape, copy, or compile Content into any database, dataset, archive, or competing service;
- use any tool to generate text, images, video, or audio that presents itself as written, made, said, or endorsed by me.
I expressly reserve all rights to text and data mining of the Site, including under Article 4(3) of EU Directive 2019/790, except as this section allows. A robots.txt file or other technical setting that permits access does not grant any license beyond this section. For licensing requests, email contact@jurelleenterprises.com.
9. Trademarks
“Jurelle Enterprises,” “Tyler Jurelle,” and the related names and logos are trademarks of Jurelle Enterprises LLC. Without my written permission, you may not use them, or anything confusingly similar, in a domain name, social media handle, business or product name, advertisement, or search ad keyword, or in any way that suggests I sponsor or endorse you. You may use the company’s name to refer accurately to it or its work, such as when citing or reviewing it.
Other product and company names on the Site, such as Asana, Google Workspace, Microsoft 365, and Apple Business, belong to their owners and are used only to describe the tools I work with. A certification from a company, such as Certified Asana Administrator, does not make me its partner, reseller, or representative, and the appearance of these names does not mean those companies endorse me.
10. Messages and Other Submissions
- You are responsible for what you send me through the Site. You confirm that you have the right to share it and that it does not break the law or these Terms.
- Do not send passwords, financial account numbers, government ID numbers, or health information through the contact form or by email.
- You keep ownership of what you send. I use the business details you share in an inquiry only to reply to you, recommend a service, and prepare a scope, and I do not publish them. A formal duty of confidentiality exists only under a signed agreement.
- Unsolicited ideas, pitches, and proposals are not confidential. I may already be developing similar ideas, and I may use any idea without obligation or payment to you.
11. Professional Services
The Site describes the operations and systems consulting services of Jurelle Enterprises LLC, listed under Services. Nothing on the Site, including published prices, service levels, timelines, or deliverables, is an offer or a promise to work. Prices shown as “from” or “starting at” are starting points, and I confirm the service level and price in writing before you pay anything.
An engagement exists only once we have agreed on the scope in writing, in a signed agreement or a written scope confirmation, and that document governs the scope, fees, payment, timeline, ownership of deliverables, confidentiality, cancellation, and liability for the work. Sending an inquiry does not create an agreement or a confidential relationship. Published prices and services may change at any time, but a change does not affect an agreement already in place.
12. Administrative Work Only
The services and Content on the Site cover operations, administration, and systems. They are not legal, tax, accounting, financial, investment, regulatory, compliance, or human resources advice, and nothing on the Site creates a professional relationship of that kind. I do not perform work that requires a license I do not hold.
Information on the Site is general and may not fit your situation, so check anything with legal, tax, financial, or regulatory consequences with a qualified professional before relying on it. Results depend on your business, your team, and how the systems are used, and I do not guarantee any particular outcome.
13. Tools, Recommendations, and Commissions
- I may recommend software or services as part of my work. You buy them directly from their providers, under the providers’ own terms and prices. I do not resell or mark up licenses.
- If I earn a commission or referral fee from a tool I recommend, I disclose it when I recommend it, and I name an alternative. You decide whether to buy.
- I am not responsible for the products, availability, pricing, security, or support of tools made by other companies, including changes a provider makes to its features or plans after I recommend or set it up.
14. Third-Party Links and Services
Links to other companies’ websites and tools are provided for convenience and reference. I do not control those websites and am not responsible for their content, products, policies, or practices. You use them at your own risk and under their terms.
tylerjurelle.com is run by the same company under its own Terms of Use and Privacy Policy.
15. Copyright Complaints
If you own something on the Site, such as a photograph, and want credit added or corrected, or something taken down, email contact@jurelleenterprises.com. A formal notice is not needed for that.
To send a formal notice under the Digital Millennium Copyright Act, email contact@jurelleenterprises.com with the subject line “Copyright Notice” and include:
- your name, mailing address, phone number, and email address;
- a description of the copyrighted work;
- the URL of the material on the Site;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law;
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner;
- your physical or electronic signature.
I will review valid notices promptly and remove or disable material where appropriate. If your material was removed and you believe that was a mistake, you can send a counter-notice that includes the information required by 17 U.S.C. § 512(g)(3). Knowingly false notices or counter-notices can lead to liability under 17 U.S.C. § 512(f).
16. No Warranties
The Site and its Content are provided “as is” and “as available.” To the fullest extent permitted by law, I disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and availability. I do not promise that the Site will be uninterrupted, secure, or error-free, or that any Content is complete or current. Any warranty for paid work is only what the written agreement for that work provides.
17. Limitation of Liability
To the fullest extent permitted by law, neither I, Tyler Jurelle, nor my contractors or agents will be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Site, its Content, these Terms, or any third-party website, product, or service, even if advised that such damages were possible. My total liability for all claims related to the Site or these Terms is limited to US $100. Liability for paid work is governed by the written agreement for that work.
These limits do not apply to liability for fraud, gross negligence, or willful misconduct, or to any other liability that New Jersey law or the law that applies to you does not allow to be limited.
18. Indemnification
You agree to defend, indemnify, and hold harmless me, Tyler Jurelle, and my contractors and agents from any claims, losses, liabilities, damages, and costs, including reasonable attorneys’ fees, arising from your breach of these Terms, your misuse of the Site or its Content, your submissions, or your violation of any law or anyone’s rights. I may take control of the defense of any such claim, and you agree to cooperate.
19. Disputes and Governing Law
- Contact me first. Before filing any claim, email contact@jurelleenterprises.com describing the issue and what you are asking for, and give me 30 days to try to resolve it informally.
- Governing law. New Jersey law governs these Terms and any dispute about the Site, without regard to conflict of laws rules, together with applicable United States federal law.
- Courts. Except as allowed below, any dispute must be brought in the state or federal courts located in New Jersey, including small claims court for claims that qualify, and both of us consent to their jurisdiction.
- Protecting my rights. I may ask any court with jurisdiction for an injunction or other urgent relief to stop misuse of my Content, trademarks, or Likeness, or harm to the Site.
- Visitors in the EU, UK, and Switzerland. These Terms do not take away the protection of the mandatory consumer laws of the country where you live, or your right to bring a claim in its courts.
- Paid work. Disputes about paid work follow the written agreement for that work where it covers them.
20. Suspension and Termination
I may change, suspend, or discontinue any part of the Site, and block or end anyone’s access, at any time and without notice, including for a breach of these Terms. Sections that by their nature should continue, including those on ownership, Likeness, AI, warranties, liability, indemnification, and disputes, survive.
21. Changes to These Terms
I may update these Terms. Changes take effect when posted on this page with a new “Updated On” date, and using the Site after that means you accept them. Changes do not apply to a dispute you notified me about before they were posted.
22. General Terms
- Entire agreement. These Terms are the entire agreement between you and me about the Site. They do not replace any written agreement for paid work.
- Severability. If a court finds any part of these Terms unenforceable, that part will be enforced as far as possible and the rest stays in effect.
- No waiver. If I do not enforce a right, I have not waived it.
- Assignment. You may not transfer your rights under these Terms. I may transfer mine, including to a successor business.
- Events beyond my control. I am not responsible for delays or failures caused by events beyond my reasonable control, such as outages, natural disasters, or government action.
- Notices. You agree that notices I send by email or post on the Site satisfy any requirement that notice be in writing.
- Headings. Section titles are for convenience only.
23. Contact
